1. Who These Terms Apply To
These Terms of Service ("Terms") govern your use of SalesOptimize, operated by a French micro-entreprise ("we", "us", "our"). By using our service — whether the free diagnostic or the paid AI Audit — you agree to these Terms.
If you're using SalesOptimize on behalf of a company, you confirm you have authority to bind that company to these Terms.
2. The Service
SalesOptimize provides:
- Free Sales Diagnostic — an 18-question assessment that scores your sales organization across 6 dimensions and identifies your top 3 priorities
- AI Audit Report ($49) — a detailed AI-generated analysis of your sales operations, including review of business documents you upload
The diagnostic and audit are analytical tools. They provide information and recommendations based on your inputs. They are not consulting services, and results are not guaranteed.
3. Eligibility
You must be at least 18 years old and have legal authority to use this service and accept these Terms. SalesOptimize is designed for businesses — if you're an individual consumer, these Terms still apply but some provisions may be modified by applicable consumer protection law.
4. The Free Diagnostic
The free sales diagnostic is genuinely free. No credit card required. No hidden fees. We ask for your email to send you results.
By providing your email, you consent to receiving your diagnostic results and, optionally, follow-up emails about improving your sales. You can unsubscribe from follow-up emails at any time via the unsubscribe link in any email.
5. The AI Audit — Paid Service ($49)
What you get: A comprehensive AI-generated audit report analyzing your sales operations across 6 dimensions, incorporating your diagnostic responses and any documents you upload.
Delivery: Reports are typically delivered to your email within 2–5 minutes of document processing. Delivery time may vary based on document volume and complexity.
Documents: You may upload business documents (CRM exports, pitch decks, P&L statements, etc.) to enhance the analysis. By uploading, you confirm:
- You own or have rights to share the documents
- The documents don't contain third-party confidential information you're not authorized to share
- You consent to AI processing of the documents for report generation
Limitations: The AI Audit is an analytical tool, not professional consulting. Recommendations are based on the information you provide. We don't guarantee specific business outcomes from following the report's recommendations.
6. Payment Terms
The AI Audit is a one-time payment of $49 USD (or equivalent). Payment is processed securely by Stripe.
- Payment is due at time of purchase
- Prices may change; you pay the price shown at checkout
- All sales are in USD unless otherwise specified
7. Refund Policy
We want you to be satisfied. Our refund policy:
- Before report delivery: Full refund if you contact us before your report is generated and emailed
- After report delivery: If the report fails to deliver (technical error, not received), we will re-deliver or issue a full refund
- Dissatisfied with content: Contact us at salesoptimize@polsia.app within 7 days. We review each case individually and will work to make it right
Refunds are not available if you simply disagree with the recommendations or changed your mind after receiving a valid report.
8. Acceptable Use
You agree not to:
- Upload documents containing illegal content, malware, or content that violates third-party rights
- Attempt to reverse-engineer, scrape, or copy our AI models or diagnostic methodology
- Use automated tools to generate bulk fake diagnostic sessions
- Misrepresent your identity or company when using the service
- Use the service in any way that violates applicable laws
9. Intellectual Property
Our property: SalesOptimize's diagnostic framework, AI models, report templates, and platform are our intellectual property. You may not copy, reproduce, or distribute them without written permission.
Your property: You retain all ownership of documents you upload. We don't claim any rights to your business data or documents.
Your report: Once delivered, your AI Audit report is yours to use however you see fit — share it with your team, board, investors, etc.
10. Disclaimer of Warranties
SalesOptimize is provided "as is." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the service will be error-free, uninterrupted, or that the reports will be accurate, complete, or suitable for your specific situation. AI-generated analysis may contain errors or outdated information.
11. Limitation of Liability
To the maximum extent permitted by law, our total liability to you for any claims arising from your use of SalesOptimize shall not exceed the amount you paid us in the 12 months preceding the claim (or $49 if you've made only one purchase).
We are not liable for indirect, consequential, incidental, or punitive damages, including lost profits or business decisions made based on our reports.
Note for EU/French consumers: Nothing in these Terms limits rights you have under mandatory consumer protection law, which cannot be contractually excluded.
12. Privacy
Your use of SalesOptimize is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our service, you agree to our data practices as described there.
13. Governing Law & Disputes
These Terms are governed by French law. For EU consumers, you also benefit from the mandatory consumer protection laws of your country of residence.
Before pursuing any formal dispute, please contact us at salesoptimize@polsia.app — we resolve the vast majority of issues by email.
EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
14. Changes to These Terms
We may update these Terms as our service evolves. We'll notify you of material changes via email. Continued use after the effective date of changes constitutes acceptance. If you disagree with changes, stop using the service and contact us for a pro-rated refund if applicable.
